What happens when tender gets approved, and one of the consortium partners (if something happens) decides to leave the consortium during the realisation?
Pursuant to article 1.9.4 of the Programme Implementation Agreement, the Parties should promptly inform each other of any circumstances that interfere or threaten to interfere with the successful implementation of the programme. Any change in the composition of the consortium qualifies as a such circumstance.
The FMO will assess on a case-by-case basis the impact of such a change and decide the way forward taking into account, in particular, whether this change would call into question the decision to appoint the specific consortium as Fund Operator.
